    These Terms and Conditions (“Terms”) govern the use of socialwipeout.com (“Website”), the purchase of Social Wipeout (“Product”), and certain matters relating to participation in the Social Wipeout party game.

    Please read these Terms carefully before purchasing or using the Product.

    By purchasing the Product or using the Website, you agree to these Terms. By voluntarily choosing to participate in the game, players acknowledge the adult, provocative and unpredictable nature of Social Wipeout as further described below.

    Nothing in these Terms excludes, restricts or limits any statutory consumer right, legal protection or liability that cannot lawfully be excluded or limited.

    2. Player Conduct, Assumption of Risk and Limitation of Liability

    Nature of the Product

    Social Wipeout is an adult party game intended solely for persons aged 18 years or older. The Product is deliberately provocative and may involve mature themes, personal questions, embarrassing situations, voluntary disclosures, use of personal devices, social interactions and challenges that some individuals may find uncomfortable, offensive or inappropriate.

    By choosing to participate, players acknowledge the nature of the Product and accept the ordinary and reasonably foreseeable social consequences associated with voluntarily participating in this type of adult party game.

    This does not waive any right that cannot lawfully be waived.

    Voluntary Participation

    Participation in Social Wipeout is voluntary at all times.

    Each player is independently responsible for deciding whether to participate in the game, draw or perform a card, answer a question, disclose information, show content from a device or participate in any other activity arising during gameplay.

    A player’s initial decision to participate does not constitute unlimited or irrevocable consent to every subsequent challenge.

    Any player may stop participating or refuse an activity at any time.

    Other players must respect that decision.

    Meaning of Game Language

    Expressions used in the Product or Rulebook including, without limitation, “Nothing Is Off Limits,” “No Escape,” “No Exceptions,” “No Going Back,” “Full Commitment,” “No Mercy,” “Say. Show. Survive.” and “Play At Your Own Risk” form part of the creative identity, humour and internal gameplay mechanics of Social Wipeout.

    Such expressions do not override applicable law, physical safety, privacy rights, third-party rights or the requirement for consent.

    Where a rule states that a player has “no escape” or that there are “no exceptions,” this means that the relevant gameplay mechanism does not provide a Wild, Safe or other in-game escape option. It does not mean that a person can be physically forced, threatened or unlawfully coerced into performing an activity.

    Player Responsibility

    Players remain responsible for their own decisions, conduct and interactions before, during and after gameplay.

    Social Wipeout does not supervise individual game sessions and cannot control the environment in which the Product is used, the people participating, their relationships, their interpretation of a card or their conduct.

    Players are responsible for exercising reasonable judgment and for complying with applicable laws.

    A game card is not an instruction, authorisation or justification to engage in unlawful, unsafe or non-consensual conduct.

    Independent Conduct of Other Players

    Social Wipeout is not responsible for independent statements, actions or decisions made by players that are not legally attributable to Social Wipeout.

    This includes, where applicable, conduct involving bullying, harassment, threats, discrimination, violence, coercion, unauthorised recording, unlawful disclosure of information, invasion of privacy or misuse of another person’s property or device.

    The presence of a prompt in the Product does not authorise any participant to violate another person’s legal rights.

    Personal Information and Voluntary Disclosure

    Some cards may encourage players to answer personal questions or voluntarily reveal information.

    Each player is responsible for deciding what information they are comfortable disclosing.

    Players should not disclose confidential information, passwords, financial information, authentication codes, private identifying information or information concerning another person where they do not have the right or permission to disclose it.

    Social Wipeout does not require players to surrender control of their accounts or provide Social Wipeout with access to their personal devices.

    Phones and Personal Devices

    Where gameplay involves a phone or other personal device, the owner of that device remains responsible for deciding what content is accessed, displayed, transmitted or disclosed.

    Social Wipeout does not access players’ phones, accounts, messages, photographs, contacts or other private content merely because the Product contains a prompt involving a device.

    Players must not access another person’s device or account without permission.

    Third-Party Privacy

    A Social Wipeout card does not provide permission to disclose private communications, photographs, videos or personal information belonging to another person.

    Players remain responsible for respecting applicable privacy, confidentiality, intellectual-property and data-protection rights.

    Recording and Social Media

    Social Wipeout does not require players to record or publicly distribute gameplay unless expressly stated otherwise in a specific promotional activity governed by separate terms.

    Players who photograph, film, record, livestream, upload or otherwise distribute content involving other people are independently responsible for obtaining any consent or permission required by applicable law.

    Social Wipeout is not responsible for independent publication of gameplay content by players or third parties where that publication is not carried out by or legally attributable to Social Wipeout.

    Social and Personal Consequences

    Because Social Wipeout is intentionally designed to create provocative social interactions, gameplay may result in embarrassment, awkwardness, disagreement, offence, arguments or the voluntary revelation of information that participants were previously unaware of.

    To the maximum extent permitted by applicable law, Social Wipeout does not assume responsibility merely because voluntary gameplay results in interpersonal consequences such as disagreements between friends, relationship disputes, social-media reactions, embarrassment or reputational consequences arising from information or conduct voluntarily disclosed or undertaken by participants.

    Nothing in this provision excludes liability where such liability cannot lawfully be excluded.

    Physical Activities and Consent

    Any physical interaction arising during gameplay requires the consent of every person involved.

    Players must consider their surroundings, physical condition and personal limitations before undertaking a physical activity.

    No participant should perform an activity that they reasonably believe would create an unacceptable risk of injury.

    A player’s refusal to participate in physical contact must always be respected.

    Nothing printed on a card constitutes consent on behalf of any person.

    Alcohol and Other Substances

    Social Wipeout does not require the consumption of alcohol or any other intoxicating substance unless a separately marketed version expressly and lawfully provides otherwise.

    Players who choose independently to consume alcohol are responsible for their own consumption and decisions.

    The Product must not be interpreted as encouraging illegal drug use, underage drinking, dangerous consumption or conduct prohibited by applicable law.

    Social Wipeout is not responsible for independent decisions concerning alcohol or other substances except to the extent liability legally arises from conduct attributable to Social Wipeout and cannot be excluded.

    Illegal or Dangerous Conduct

    Nothing in Social Wipeout should be interpreted as requiring a player to violate applicable law or intentionally place themselves or another person in serious danger.

    If a card could reasonably be interpreted in more than one way, players should choose a lawful and reasonably safe interpretation.

    Modification of the Game

    Players may choose to create house rules or modify gameplay for their own private use where lawful.

    Any unofficial challenges, drinking rules, penalties, dares, modifications or activities introduced by players are not official Social Wipeout rules.

    Social Wipeout assumes no responsibility for independently created rules or activities except where liability cannot legally be excluded.

    Hosts, Venues and Event Organisers

    Social Wipeout does not control private homes, bars, clubs, events or other locations in which the Product may be played.

    Hosts, venue operators and event organisers remain responsible for matters within their own control and for complying with laws applicable to their activities.

    The purchase or use of Social Wipeout does not create an agency, partnership, employment, franchise or endorsement relationship between Social Wipeout and any host, venue, influencer, reseller or event organiser.

    No Guarantee of Experience

    Individual reactions to an adult party game are subjective.

    Social Wipeout does not guarantee that every participant will find every card funny, comfortable, appropriate or enjoyable, or that gameplay will produce any particular social outcome.

    This does not affect a consumer’s right to receive a Product that conforms to the sales contract.

    Misuse

    Social Wipeout is not responsible, to the extent permitted by applicable law, for loss or damage resulting from deliberate misuse of the Product, disregard of clearly communicated safety instructions, unlawful conduct, unauthorised modifications or use materially outside the Product’s reasonably intended purpose, where such loss or damage is caused by that conduct.

    Third-Party Services

    Social Wipeout may interact with independent services such as payment processors, delivery companies, fulfilment providers, social-media platforms and ecommerce technology providers.

    The involvement of a third party does not automatically make Social Wipeout responsible for conduct legally attributable solely to that third party.

    Nothing in this provision transfers to the consumer a responsibility that applicable law places on Social Wipeout as the seller.

    Counterfeit and Unauthorised Products

    Social Wipeout is not responsible for counterfeit, pirated, altered or unauthorised copies of the Product that were not manufactured, supplied or sold through Social Wipeout or an authorised sales channel, except where applicable law provides otherwise.

    Indirect and Consequential Loss

    To the maximum extent permitted by applicable law, Social Wipeout shall not be liable for indirect or consequential loss that is not a reasonably foreseeable consequence of a breach attributable to Social Wipeout.

    Any limitation in these Terms applies only to the extent permitted by applicable mandatory law.

    Maximum Lawful Limitation of Liability

    Nothing in these Terms is intended to exclude, restrict or limit liability where doing so is prohibited by applicable law.

    Subject to that principle, and to the maximum extent permitted by applicable law, Social Wipeout excludes or limits liability for loss or damage resulting from:

    1. conduct independently chosen or undertaken by players or third parties;
    2. voluntary disclosure of information by a participant;
    3. unauthorised disclosure, recording or publication undertaken by another player or third party;
    4. use of the Product contrary to clearly communicated instructions or warnings;
    5. unofficial modifications, house rules or challenges created by users;
    6. unlawful or non-consensual conduct undertaken by players;
    7. circumstances outside Social Wipeout’s reasonable control, to the extent permitted by law; or
    8. other conduct or circumstances for which applicable law does not impose liability on Social Wipeout.

    Nothing in these Terms excludes or limits liability, remedies or consumer rights that cannot legally be excluded or limited.

    In particular, these Terms do not seek to exclude mandatory rights relating to product conformity, product safety, statutory consumer guarantees, fraud, or death or personal injury where applicable law prohibits such exclusion.

    Mandatory Consumer Rights

    Nothing contained in the Rulebook, Website, packaging, marketing materials, disclaimers, policies or these Terms removes any mandatory consumer right available under applicable law.

    Where a provision of these Terms conflicts with mandatory consumer law, the mandatory law prevails to the extent of that conflict.

    The remainder of the Terms shall continue to apply to the extent legally possible.

    Severability

    If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be interpreted or applied to the maximum extent legally permissible where the applicable law allows this.

    The remaining provisions shall remain unaffected to the extent permitted by applicable law.

    No Waiver

    A failure or delay by Social Wipeout in exercising a contractual right does not by itself constitute a waiver of that right or prevent its later exercise, except where applicable law provides otherwise.

    Hierarchy and Interpretation

    These Terms should be read together with the applicable Returns & Refund Policy, Right of Withdrawal information, Shipping Policy, Privacy Policy and Cookie Policy.

    The Rulebook governs gameplay mechanics.

    These Terms govern the contractual and legal relationship between Social Wipeout and its customers and users.

    Creative or humorous language appearing in the Rulebook, on cards, packaging, advertising or the Website must not be interpreted as overriding these Terms, applicable law, consent or mandatory consumer rights.

    3. Product Information

    We make reasonable efforts to accurately represent Social Wipeout on the Website.

    Minor variations may occur in colours, packaging, printing, materials, dimensions, photographs or other visual characteristics as a result of manufacturing, screen settings or reasonable production changes.

    Such minor differences do not affect statutory rights concerning materially defective or non-conforming Products.

    4. Product Safety

    Applicable product-safety and traceability information will be provided as required before the Product is commercially placed on the relevant market.

    Applicable warnings and safety information will appear on the Product, packaging, accompanying documentation and/or Website where legally required.

    5. Orders

    Placing an order constitutes an offer to purchase the Product.

    We may refuse or cancel an order where reasonably necessary and legally permitted, including in cases involving suspected fraud, unauthorised payment, obvious pricing or technical errors, stock unavailability, legal restrictions or inability to fulfil the order.

    If an order is cancelled after payment has been received and no lawful deduction applies, the applicable payment will be refunded.

    6. Prices

    Prices will be displayed in accordance with applicable consumer law.

    VAT and other mandatory charges will be included or disclosed as required.

    Shipping costs and other mandatory additional charges will be disclosed before completion of the order.

    We may change prices for future transactions. Changes do not retroactively alter the agreed price of an existing binding order.

    7. Pricing Errors

    We make reasonable efforts to ensure prices are correct.

    If an obvious and recognisable pricing or technical error occurs, we may contact the customer to correct the issue or cancel the affected transaction where permitted by applicable law.

    Payments received for an order validly cancelled for this reason will be refunded.

    8. Payment

    Customers must use one of the payment methods offered at checkout.

    By submitting payment details, the customer confirms that they are authorised to use the selected payment method.

    Payments may be processed through third-party payment providers.

    9. Fraud Prevention

    We may use reasonable and lawful measures to prevent fraudulent orders, unauthorised transactions and payment abuse.

    Additional verification may be requested where reasonably necessary and legally permitted.

    Nothing in this provision limits a customer’s legitimate right to dispute an unauthorised or incorrect transaction.

    10. Shipping and Fulfilment

    Social Wipeout may use third-party fulfilment and logistics providers.

    Orders may currently be fulfilled and dispatched from China.

    Orders are normally processed and dispatched within up to 10 business days, unless another timeframe is communicated before purchase.

    Dispatch time and delivery time are different.

    Estimated delivery periods may vary by destination, shipping provider, customs processing and other circumstances.

    Applicable delivery information will be provided before purchase as required by law.

    11. Customs and Import Charges

    International shipments may be subject to customs processing, import VAT, duties or other charges depending on the destination and applicable arrangements.

    Any charges that the customer is legally required to bear will be disclosed before purchase where required by applicable law.

    Nothing in these Terms transfers taxes or costs to a customer where applicable law requires Social Wipeout to bear them.

    12. Delivery Delays

    We will make reasonable efforts to deliver within the period communicated to the customer.

    Customers retain all mandatory statutory remedies relating to delayed or failed delivery.

    13. Shipping Information

    Customers are responsible for providing accurate and complete shipping information.

    We cannot guarantee changes after an order has entered fulfilment.

    Reasonable additional costs caused solely by incorrect information supplied by the customer may be charged where permitted by law.

    14. Lost, Damaged, Incorrect or Incomplete Orders

    Please contact us if a Product is lost, damaged during delivery, incorrect or incomplete.

    We may reasonably request photographs of the Product or packaging and order information to investigate the issue.

    Where Social Wipeout is legally responsible, an appropriate remedy will be provided in accordance with applicable law.

    15. EU/EEA Right of Withdrawal

    Where applicable EU/EEA consumer law provides a statutory right of withdrawal, consumers generally have 14 calendar days to withdraw from an online purchase without providing a reason.

    For goods, this period generally begins when the consumer, or a third party designated by the consumer other than the carrier, receives the Product.

    The customer must communicate their decision to withdraw before the applicable period expires.

    16. Returns

    After exercising a valid right of withdrawal, the customer must return the Product within the applicable statutory period.

    Customers should contact us before returning a Product so that return instructions can be provided.

    17. Return Shipping Costs

    For a change-of-mind withdrawal, the customer bears the direct cost of returning the Product where the customer has been properly informed of this before purchase.

    Where a Product is defective, non-conforming, incorrect or damaged in circumstances for which Social Wipeout is legally responsible, costs will be handled in accordance with applicable mandatory consumer law.

    18. Condition of Returned Products

    Customers may inspect the Product to the extent reasonably necessary to determine its nature, characteristics and functioning.

    If a Product has been handled or used beyond what is reasonably necessary for such inspection and its value has consequently decreased, we may deduct the resulting diminished value from the refund to the extent permitted by applicable law.

    Examples may include missing cards or components, written-on cards, stains, tears, significant bending, missing instructions or other use or damage that materially reduces the Product’s value.

    Opening the packaging does not automatically eliminate a statutory right of withdrawal.

    19. Refunds

    Valid refunds will be processed in accordance with applicable consumer law.

    Where legally required, reimbursement will include the Product price and the cost of the least expensive standard outbound delivery option offered by us.

    Additional costs resulting from the customer’s choice of a more expensive shipping method need not be refunded where applicable law permits.

    Where permitted, reimbursement may be withheld until we receive the Product or the customer provides evidence of having returned it.

    Refunds will generally be made through the original payment method unless otherwise lawfully agreed.

    20. Defective or Non-Conforming Products

    The 14-day withdrawal right is separate from statutory rights concerning defective or non-conforming Products.

    Customers retain all mandatory statutory guarantee rights.

    Depending on applicable law and circumstances, remedies may include repair, replacement, price reduction, refund or termination of the sales contract.

    21. Intellectual Property

    All applicable intellectual-property rights associated with Social Wipeout remain owned by Social Wipeout and/or the relevant rights holders.

    Protected material may include the Social Wipeout name, logo, branding, artwork, original card text, questions, challenges, graphic elements, packaging, rulebook, Website content, photographs, videos and advertising materials.

    Purchase of the Product transfers ownership of the physical copy purchased. It does not transfer intellectual-property rights.

    22. Prohibited Commercial Copying

    Except where permitted by applicable law, users may not commercially reproduce, manufacture, scan, distribute, publish, sell or create counterfeit copies of protected Social Wipeout material.

    Users may not falsely represent themselves as Social Wipeout or as an authorised Social Wipeout partner or distributor.

    Nothing in this section restricts uses expressly permitted by mandatory applicable law.

    23. Reviews and User-Generated Content

    Customers may have opportunities to submit reviews, photographs, videos, testimonials or other content.

    The person submitting content must have the necessary rights and permissions.

    Content must not knowingly violate intellectual-property, privacy, image or other legal rights.

    Where content is voluntarily submitted specifically for publication or promotional use, Social Wipeout may receive a non-exclusive, worldwide, royalty-free licence to use that content for the disclosed purposes, subject to applicable law and any consent requirements.

    24. Playtesting

    Participation in a Social Wipeout playtest does not automatically constitute permission for Social Wipeout to commercially publish a participant’s image, voice or identifiable recording.

    Where playtesting is filmed or photographed for promotional purposes, separate consent or an appropriate release may be requested.

    25. Website Use

    The Website may only be used for lawful purposes.

    Users must not knowingly attempt unauthorised access, interfere with Website security, introduce malicious software, commit fraud, impersonate another person, unlawfully copy protected content or otherwise use the Website unlawfully.

    26. Website Availability

    We do not guarantee uninterrupted availability of the Website.

    Maintenance, technical failures, updates, security issues, provider outages or circumstances outside our reasonable control may temporarily affect availability.

    Existing contractual and mandatory consumer obligations remain unaffected.

    27. Promotions and Discount Codes

    Promotions, discount codes, giveaways or competitions may be subject to additional conditions.

    Promotional benefits may be refused or cancelled where obtained through fraud, manipulation or technical abuse, where permitted by law.

    Mandatory consumer rights remain unaffected.

    28. Force Majeure

    Where permitted by law, Social Wipeout will not be responsible for delays or failures caused by circumstances genuinely outside our reasonable control, including severe transportation disruption, natural disasters, war, government restrictions, major infrastructure failures, strikes, epidemics or similar events.

    Mandatory consumer rights concerning delivery, cancellation and reimbursement remain unaffected.

    29. Privacy and Data Protection

    Personal information collected through socialwipeout.com will be processed in accordance with our Privacy Policy and applicable data-protection legislation, including the GDPR where applicable.

    The Privacy Policy will explain what information is collected, why it is processed, applicable legal bases, recipients/service providers, international transfers, retention periods, marketing practices, cookies and data-subject rights.

    30. Cookies

    The Website may use cookies and similar technologies.

    Where applicable law requires consent, non-essential cookies will only be used after appropriate consent has been obtained.

    Further information will be available through the Website’s Privacy/Cookie Policy and cookie settings.

    31. Complaints

    Customers should provide sufficient information for us to identify the relevant order and investigate the matter.

    Complaints will be handled within a reasonable period and in accordance with applicable consumer law.

    32. Governing Law

    These Terms are governed by the laws of The Netherlands, except where mandatory consumer-protection rules provide otherwise.

    A consumer residing in another jurisdiction does not lose mandatory protections that applicable law does not permit to be contractually excluded.

    33. Disputes

    Customers are encouraged to contact us first so that disputes can be resolved amicably where possible.

    Nothing in these Terms prevents a consumer from bringing a claim before a court that has jurisdiction under applicable mandatory law.

    34. Changes to These Terms

    We may update these Terms when reasonably necessary due to changes in law, the Product, Website, business operations, payment systems or fulfilment arrangements.

    Changes will not retroactively remove rights already acquired under an existing contract.

    The version applicable to an order will generally be the version provided when that order was placed.
